These Terms of Service ("Terms") are a binding legal agreement between you ("you" or "User") and Drinking Buddies, an unincorporated venture operated by its co-founders Christian Liszewski and Patrick Chudecki (together, "Drinking Buddies," "we," "us," or "our"), governing your access to and use of the Drinking Buddies mobile application, any related services, and the drinkingbuddies backend (collectively, the "App" or "Service").

BY CREATING AN ACCOUNT, DOWNLOADING, ACCESSING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.

About Our Name

"Drinking Buddies Inc." is a stylized brand name and a play on words — it is not a representation that Drinking Buddies is incorporated or registered as a corporation. Drinking Buddies is operated directly by its co-founders, Christian Liszewski and Patrick Chudecki.

Drinking Buddies allows users to log alcoholic (and non-alcoholic) beverages they consume, view personal statistics, connect with friends, participate in social features (feed, reactions, comments, leaderboards, streaks, challenges), and optionally use camera-based, AI-assisted drink recognition to help estimate what they are drinking.

2.1 Not a Medical, Safety, or Monitoring Device

The App is for entertainment and social/self-tracking purposes only. It is not a medical device, breathalyzer, blood-alcohol-content (BAC) estimator, or substitute for professional medical, legal, or safety advice. Standard-drink counts, ABV estimates, and AI-based drink recognition results are approximations only, may be inaccurate, and must never be used to determine whether it is safe for you or anyone else to drive, operate machinery, or engage in any activity requiring sobriety.

2.2 Responsible Use / No Inducement to Drink

Gamified features (streaks, badges, tokens, rank-ups, leaderboards, challenges, and similar mechanics) are provided solely for entertainment and social engagement. They are not intended to encourage you to consume alcohol, to consume more than you otherwise would, or to drink to maintain a streak, rank, or reward. You should never let any feature of the App influence a decision about whether, or how much, to drink. Never drink and drive. If you or someone you know may have a problem with alcohol, contact the SAMHSA National Helpline at 1-800-662-4357 (US) or a local equivalent.

3. Accounts

You must create an account to use most features of the App, via email/password or Sign in with Apple. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at drinkingbuddiesinc@gmail.com of any unauthorized use.

4. User Content

The App lets you submit photos, drink logs, comments, reactions, profile information, and other content ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant Drinking Buddies a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely to operate, provide, and improve the App (for example, showing your posts and photos to your friends in the social feed and story features).

You represent that you own or have the necessary rights to any User Content you submit, and that it does not violate any third party's rights or any law. We may remove any User Content that violates these Terms or that we determine, in our discretion, is inappropriate, without prior notice.

4.1 Copyright / DMCA

If you believe User Content on the App infringes your copyright, send a notice to drinkingbuddiesinc@gmail.com containing: identification of the copyrighted work, identification of the allegedly infringing material and its location in the App, your contact information, a statement of good-faith belief that the use is unauthorized, a statement that the notice is accurate and made under penalty of perjury, and your physical or electronic signature.

5. Prohibited Conduct

You agree not to: (a) use the App if you are under the legal drinking age to log alcoholic beverages; (b) impersonate any person or entity; (c) harass, bully, or threaten other users; (d) post content that is unlawful, obscene, defamatory, or that promotes illegal drug use, drunk driving, or excessive/dangerous drinking (e.g., binge-drinking "challenges" aimed at intoxication); (e) attempt to manipulate tokens, rankings, streaks, or other in-App metrics through fraud, exploits, or automation; (f) reverse-engineer, decompile, or scrape the App or its backend; or (g) use the App for any commercial purpose without our written consent.

6. Virtual Items, Tokens, and Purchases

The App may offer virtual currency ("Buddy Gold"/tokens) and, in a future version, real-money in-app purchases and subscriptions processed exclusively through Apple's In-App Purchase system. Virtual items have no cash value, are not redeemable for real money, are non-transferable, and may be modified, suspended, or removed at our discretion. All real-money purchases are billed by and refundable only per Apple's own policies at reportaproblem.apple.com — Drinking Buddies does not process payments or issue refunds directly.

7. Third-Party Services

The App relies on third-party infrastructure, including Supabase (backend/database/auth/storage), Apple (Sign in with Apple, push notifications, payments), and an AI vision service used solely to analyze photos you submit for drink recognition. Your use of these integrations is also subject to those providers' own terms. See our Privacy Policy for details on data shared with these providers.

8. Assumption of Risk

Alcohol consumption carries inherent risks, including impaired judgment, addiction, injury, and death. Social features may facilitate connections or in-person meetups with other users. You voluntarily and knowingly assume all risks associated with consuming alcohol, using the App's drink-tracking and social features, and any interactions — online or in person — with other users you meet through the App. Drinking Buddies has no ability to verify the identity, intentions, or conduct of other users and is not responsible for their actions.

9. Disclaimer of Warranties

The app and service are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the app will be uninterrupted, error-free, secure, or that drink-recognition or standard-drink calculations will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, drinking buddies, its co-founders, and their respective affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or health/bodily-injury-related damages, arising out of or related to your use of (or inability to use) the app, any conduct of another user, any content, or any decision you make regarding alcohol consumption based on information in the app — even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, drinking buddies' total aggregate liability for all claims relating to the app will not exceed the greater of (a) one hundred u.s. dollars ($100), or (b) the amount you paid us, if any, in the twelve (12) months before the claim arose.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not fully apply to you, and nothing in these Terms limits any liability that cannot be limited under applicable law (including, where applicable, liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by our negligence, to the extent such liability cannot be lawfully excluded).

11. Indemnification

You agree to defend, indemnify, and hold harmless Drinking Buddies and its co-founders from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of or related to: your User Content; your violation of these Terms; your violation of any law or third-party right; or your use of the App's social/meetup features in connection with another user.

12. Dispute Resolution — Binding Arbitration & Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

12.1 Contact Us First

By accepting these Terms, you acknowledge and agree that if any dispute, claim, or disagreement arises from your use of the App, your sole remedy is to contact us directly at drinkingbuddiesinc@gmail.com so we can work to resolve it.

12.2 Binding Individual Arbitration

If a dispute is not resolved that way, you agree that it will be settled by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court.

12.3 Class Action and Jury Trial Waiver

You and Drinking Buddies each waive any right to a jury trial and to participate in a class action, class arbitration, or representative action. Disputes must be brought in your individual capacity only, through the process described above, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

12.4 Severability of This Section

If the class-action-waiver in Section 12.3 is found unenforceable as to a particular claim, the remainder of this Section 12 remains in effect for all other claims.

13. Governing Law

These Terms are governed by the laws of the States of Connecticut and New York, without regard to conflict-of-laws principles, and without application of the United Nations Convention on Contracts for the International Sale of Goods.

14. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the App or other users. You may delete your account at any time from within the App's Settings. Sections 4, 6–13, and 15–18 survive termination.

15. Accessibility

Drinking Buddies is committed to making the App usable by people with disabilities and has made good-faith efforts to align its interface with Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as implemented through Apple's accessibility APIs (including VoiceOver support, Dynamic Type, and sufficient color contrast). If you encounter an accessibility barrier, please contact drinkingbuddiesinc@gmail.com so we can address it. This commitment does not extend to third-party content or platforms outside our control (e.g., the iOS operating system itself).

16. Apple-Specific Terms

If you obtained the App from the Apple App Store, you acknowledge that: (a) this agreement is between you and Drinking Buddies only, not Apple; (b) Apple has no obligation to furnish maintenance or support for the App; (c) Apple is not responsible for any product warranties, whether express or implied by law, and any warranty claims are Drinking Buddies' sole responsibility to the extent required by these Terms; (d) Apple is not responsible for addressing any claims relating to the App or your possession/use of it, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation; (e) Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual-property infringement claim related to the App; (f) you will comply with applicable third-party terms when using the App (e.g., your wireless data agreement); and (g) Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

17. Changes to These Terms

We may modify these Terms from time to time. Material changes will be notified through the App or via the email associated with your account. Continued use of the App after changes take effect constitutes acceptance.

18. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. These Terms (with the Privacy Policy) constitute the entire agreement between you and Drinking Buddies regarding the App.
